Patents in Germany and Europe


Fish attorneys have authored a new book on the German patent system, addressing procurement, enforcement, and defense of patent rights. The German patent system is procedurally and substantively unique, offering opportunities and pitfalls for patentees and potential defendants. This book is targeted to a US audience, and explains the structure of Germany's system in counterpart to the United States. Chapters include:

  • Sources of law in Germany;
  • The German court system;
  • Procurement of IP rights in the German and European patent offices;
  • Invalidity challenges through oppositions and nullity actions;
  • Enforcement actions through infringement trials and customs proceedings; and
  • Employee rights in inventions.
Moreover, key provisions of German and European law are provided in the appendices, as well as sample pleadings, ending with a list of key distinctions between US and German/European law.

The book is written by Alexander Harguth of Fish's Munich office and Steven Carlson of Fish's Silicon Valley office. Together, they have attempted to present the German system in a useful and accessible manner, with extensive citation to underlying authorities.
