Piedmont Energy Co. v. Georgia Natural Gas Co.
Fish represents to Piedmont Energy Company, a subsidiary of Piedmont Natural Gas Company, in the Delaware Court of Chancery in a lawsuit seeking an order declaring Piedmont’s rights pursuant to a buy-out option under a joint venture agreement and seeking corrective disclosures of certain public filings concerning the buy-out option.
Bernstein, et al. v. Surge Global Energy Inc.
Fish represented Surge Global Energy in the Delaware Court of Chancery in an action seeking to compel a shareholder meeting under Section 211 of the DGCL and seeking to compel the production of a stockholder list under Section 220 of the DGCL. Fish obtained a favorable settlement.
CNX Gas Corporation v. CDX Gas Company LLC
Fish represented counterclaim plaintiff CDX in a patent suit in the Western District of Pennsylvania alleging infringement of multiple patents relating to improved drilling methods for draining coal bed methane from coal seams. The case settled shortly before scheduled trial.
