Most IP licenses give only formalistic consideration to bankruptcy without a basic understanding of the issues that may arise and the attendant risks to both licensor and licensee. This presentation (intended for IP professionals who must consider bankruptcy contingencies in their practice) is a high level exploration of basic bankruptcy terminology and the rights of IP licensees and licensors in bankruptcy, and also offers a few suggestions for drafting license agreements.
